Booking Terms & Conditions

These Terms and Conditions are between the CORGI Technical Services “CTS” and The Association of Safety & Compliance Professionals “ASCP” (collectively “Us”/”We”/”Our”), and the person who completes the relevant booking form (“You”) for the ASCP training and events.

Booking

  • Before booking onto a course or event, please ensure you have read the course programme and content, to ensure the course will meet your needs.
  • Upon receipt of your booking form and subsequent payment your place(s) will be confirmed.
  • Important note: Our acceptance of your booking brings into existence a contractual agreement between You and Us, on these terms and conditions. Any term sought to be imposed by you in any purchase order or correspondence will not form part of the contract.
  • All bookings are subject to availability and acceptance by Us, which will be confirmed in writing (including by e-mail) after We have received the completed booking form, the related fee (the “Fee”) (if applicable), and anything else that We may require.
  • Upon Our written confirmation to You of acceptance of your booking for a place at the Event or Training, there shall be a legally binding contract between You and Us to which these terms and conditions apply.
  • We reserve the right to refuse to accept any booking at Our absolute discretion.

Invoicing and payment

  • Fees for the Event or Training are correct at the time of publication, as stated on the booking for.

  • We reserves the right to change the fees at any time, but changes will not affect registrations which have already been confirmed.

  • Payment of all Fees must be received at least 21 working days before the event or training. We reserve the right to cancel any ticket reservations not paid for by this time.

  • For bookings made within 28 days of the Event or Training, a credit card payment or immediate bank transfer will be required.
  • Expired membership must be renewed before member discounts apply.

  • We cannot guarantee places held on a provisional basis and that places may sell out.

  • The fees do not include travel to or from the Event or Training or any accommodation costs incurred. We will take no responsibility for the provision, or lack of, travel and accommodation of any delegate.

  • Delegates from all countries are required to pay VAT @ 20% on all Events and Training taking place in the United Kingdom.

  • If booking at the AGSM/AESM or ASCP member rate, You will be required to provide the membership number for each delegate.

  • Registered delegates who do not attend the Training or Event will still be liable for the full delegate fee and will not receive any refund if payment has already been made regardless of time of booking.
  • Fees are non-transferrable (between events or training) in the case of cancellation or non-attendance.
  • We reserve the right to offer discounts at Our absolute discretion. We also reserve the right, without any liability, to withdraw such discounts.
  • We require You to provide the correct PO number if you require Us to use one, and details of Accounts Payable.

Attendance

  • Delegates will normally receive joining instructions and in the case of Training, pre-learning information.  This will be sent via email to the email address provided on the booking form approximately a week to ten days before the Training or Event.
  • Delegates must be registered at least 48 hours in advance of the start of the Event.
  • Please advise Us of any special access requirements at the time of making Your booking.
  • We reserve the right, without any liability, to refuse You admission or eject You from the Event or Training for failure to comply with these Terms; or if in Our opinion You represent a security risk, nuisance, or annoyance to the running of the Event or Training.
  • You are permitted to make reasonable video or audio recordings and to take photographs at the Event (but not Training), in each case strictly for Your own personal use. You must not make video or audio recordings of the whole (or substantially the whole) of the Event or of any session within the Event, or use any recordings or photographs for commercial purposes, unless expressly permitted by Us.
  • You are not permitted to make electronic recordings in any form, of Training courses.
  • You acknowledge that the Event or Training, or part of it, may be filmed by audio, visual, audio-visual or electronic means or photographed, including photographs of individuals or groups of delegates. You agree to permit Us, or any third party licensed by Us, to use and distribute such footage and photographs, which may feature images of You, in all or any media (including social media) whether now known or hereafter to be invented throughout the world in perpetuity for the purposes of advertising, publicity, reporting and otherwise in relation to the exploitation of such recordings and photographs. Please inform the photographer if You do not wish to be included in any individual or group photographs.
  • Materials distributed by or on behalf of Us at an Event may not be reproduced without Our permission.
  • You acknowledge and accept that We have the right to publicly announce our business relationship with You which shall include but not be limited to announcements on social media. Such announcements shall not be disparaging or otherwise adverse to You or Your business.
  • Failure to attend a Level 3 or Level 4 course induction day agreed to by the student or booker, will result in a charge of £150 + VAT to attend a future induction day if the student chooses to do so.
  • Failure to attend any other courses will result in the full cost being incurred. No refund shall be given.
  • The level 3 and 4 enrolments will expire after 3 years from the date of induction day, with the exception of the Level 4 VRQ Certificate in Managing Damp, Mould and Customer Care in Housing, and the Safety Compliance standalone modules, whereby the enrolments will expire after 12 months and 6 months respectively of the induction day. Any extension requested will be subject to charge.
  • The data we collect from you will be retained only for as long as necessary to fulfil the purposes we collected it for.

Cancellations, amendments and postponements

We understand that changes in circumstances mean that it is not always possible for an individual booked on a course/induction day to attend.  The following Terms are in place in the event you need to cancel or make changes to Your booking for Training or Events.

  • All requests for cancellations, postponements and/or transfers must be received in writing.
  • Changes will become effective on the date of written confirmation being received.
  • The appropriate cancellation charge will apply based on the cost of your booking as shown below.

Further information regarding the cancellation and amendment policy

  • The policy will apply unless You, the delegate or Your employer can fill the Level 2 delegate place with another person, in which case this must be confirmed by You in writing at least 48 hours before the course start, and will incur a £75 + VAT administration fee.
  • We cannot guarantee that the future course allocation will be in the delegate’s regional area, but will make every effort to do so.
  • If You or a Level 3 or Level 4 delegate and Your employer decide that the chosen course is unsuitable after attending the course induction day, and have not submitted any assignments, You or Your delegate, can notify Us in writing within a maximum of 4 calendar months from the induction day date to have the opportunity to transfer the course registration to another employee, once. To transfer the course to another person at this point will incur a fee of 50% of the published course list price. After 4 months, the course is no longer transferable.

Cancellation by Us

  • We know that the cancellation of a Training course or Event is inconvenient and We therefore do Our best to fulfil the published dates. However, from time to time, due to operational reasons, We reserve the right to cancel or postpone Events and Training without liability.
  • In the event of cancellation of a course by Us, We will endeavour to inform You and all delegates at the earliest opportunity before it is due to take place. New dates will be offered to You where possible, however where a suitable alternative cannot be found, We will provide a credit or refund.
  •  You agree that Our liability to You will be limited to the amount of the Fees You have paid and We will not be liable to You for any expenditure, damage, or loss incurred by You as a result of the cancellation or postponement.

Copyright

  • All training materials must not be copied, shared, recorded, modified, transmitted or distributed in any way.

Our liability

  • Views expressed by speakers at Events are their own and We disclaim all liability for advice given or views expressed during an Event. Materials distributed at an Event are intended for information only and should not be relied upon.
  • To the maximum extent permitted by law, We shall not be liable to You for any direct, indirect, economic or consequential loss or any loss of business, use, profit, anticipated profit, contracts, revenues, goodwill or anticipated savings arising in connection with this Agreement, even if You have been advised of the possibility of such loss or damage.

Your details

  • By submitting registration details, You agree to allow Us to contact You as required for the organisation and administration of the Event or Training. We will comply with our privacy policy in respect of your registration details and other information we hold about You.

  • The names, job titles and organisations of all registered delegates will be placed on the delegate list for the Event. This list will be provided to sponsoring companies and made available to delegates. If You do not wish to be included on this list, please email info@theascp.co.uk at the time of making your booking.

  • We and Our partner organisations, CORGI Technical Services, the Association of Gas Safety Managers (AGSM) and the Association of Electrical Safety Managers (AESM), will only contact you for marketing purposes if you are an existing member of Our marketing programme or have expressly consented to this (for example, by opting in during the registration process).

Other

  • If any provision of these terms is held to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed, and the remainder of the provisions will continue in full force and effect as if the terms had been executed with the invalid, illegal or unenforceable provision omitted.
  • Any express or implied waiver to perform any obligations under these terms will not prevent the subsequent enforcement of them.
  • A person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms.
  • These terms shall be governed by English Law and You hereby irrevocably submit to the exclusive jurisdiction of the English courts. Nothing in this clause shall limit Our right to take proceedings against You in any other court of competent jurisdiction.
